Complying with an Approval

All Development Permits are issued by Council subject to conditions and in accordance with approved plans and documents to ensure the development results in good land use outcomes and aligns with the approved use of the land. The conditions of the Development Permit must be complied with in order for the development to be deemed lawful development. The conditions included in a Planning Approval remain in force after the construction of the development and for the life of the relevant use on the land.

A Development Permit attaches to the land and the responsibility of complying with conditions falls to the landowner of the property. If the landowner sells land to another landowner, it will be the responsibility of the new landowner to meet the conditions of approval.      

One of the key responsibilities of our Compliance Team is to investigate and enforce compliance with Development Permit conditions.The purpose of Compliance inspections is to ensure that development work has been carried out in accordance with the approval conditions, approved plans and documents and the relevant standards.

Inspections are undertaken to determine compliance with approvals issued for a Material Change of Use (commencement of a new land use), Reconfiguring of a Lot (subdivision of land and boundary realignment) and Operational Works (earthworks, water, sewerage, roads and accesses).
