Local Laws HomeAbout CouncilCouncil DocumentsLocal Laws Public Interest Review – Proposed Waste Management Local Law Proposed Western Downs Regional Council Local Law No. 8 Waste Management 2018 Chapter 5A of the Environmental Protection Regulation 2008 and section 7 of the Waste Reduction and Recycling Regulation 2011 will expire on 1 July 2018. In response, Western Downs Regional Council recently proposed to make Western Downs Regional Council Local Law No. 8 (Waste Management) 2018. This local law will replace the expiring State Government waste management provisions and allow Council to retain its ability to manage waste matters in its local government area. The proposed Western Downs Regional Council Local Law No. 8 (Waste Management) 2018 will substantially replicate the expiring State Government waste management provisions, and seeks to protect the region’s public health, safety, and amenity related to waste management by: regulating the storage, servicing and removal of waste; and regulating the disposal of waste at waste facilities; and ensuring that an act or omission does not result in harm to human, health or safety or personal injury; or property damage or loss of amenity; or environmental harm or environmental nuisance Read the Media Release Public Submission Period In accordance with Council’s adopted local law making process, Council conducted a community consultation on the proposed Western Downs Regional Council Local Law No. 8 (Waste Management) 2018. Council also conducted a public interest test on possible anti-competitive provisions identified in proposed Western Downs Regional Council Local Law No. 8 (Waste Management) 2018. The proposed new local law contains the same type of anti-competitive provisions as exist in the expiring State legislation. Council must conduct a Public Interest Test to inform the decision about whether it is appropriate that those anti-competitive provisions be continued in the new local law. Council has prepared a Public Interest Test Plan to guide that review.
